TERMS OF SERVICE

These terms and conditions apply to all orders and receipt of acknowledgement of order by you, constitute your acceptance that our conditions are the only conditions that apply to the contract notwithstanding any purported terms put forward by you.

 

 

1. Confirmation of the order:

 

 

 

The order is considered tentatively confirmed upon signing of this Proforma and shall be executed upon the establishment of the payment terms agreed and highlighted in this proforma. Rawtech trade will continue to list and offer the material to other customers until the payments terms have been met.

 

 

 

2. Payment Confirmation

 

 

 

For Transaction through L/C:

 

Order is confirmed and will be executed once the original LC has negotiated and received in Rawtech’s bank account.Rawtech trade is not liable to ship the goods before confirmation from the bank.The complete set of documents including original B/L will be submitted to the bank after the shipment and should be released from the buyer’s side within 5 working days of receiving the documents. In the event the buyer does not release the documents on time, Rawtech Trade reserves the right to change, cancel or divert the shipment to other customers unless mutually agreed. Furthermore, the delay in documents, diversion cost and price reduction different will be claimed from the buyer and adjusted from the deposit, if any.

 

For Transaction through TT:

 

Order is considered confirmed and will be executed upon receipt of the advance payment as agreed on the proforma invoice.Rawtech trade is not liable to ship the goods upon swift copy of the buyer’s side. Shipment will be executed once the money is received in Rawtech Trade’s bank account.Advance payment should be received within 3 working days of raising the proforma or the order will be subject to cancellation.

Balance payment to be received upon copy of OBL, within 5 working days. In the event the buyer does not transfer the balance within 5 days, Rawtech Trade reserves the right to change, cancel or divert the shipment to other customers unless mutually agreed. Furthermore, the delay in documents, diversion cost and price reduction different will be claimed from the buyer and adjusted from the deposit, if any.

All bank charges of Rawtech Trade bank will be borne by Rawtech Trade and banks charges from the buyer’s bank will be borne by the buyer himself.Ownership of goods remains with seller until goods are paid for in full or bills of exchange honoured.

 

 

3. Prices

 

 

 

This proforma is valid for 3 working days. Any revision in price due to fluctuation in the market will be communicated if happens before confirming the proforma and receiving the advance payment/LC.The proforma is generated based on average quantity loading in the past. In the event the loading is more or less, the buyer will be informed and final proforma will be raised accordingly.The price mentioned in the proforma is pre-negotiated and final. Any change of circumstances due to market fluctuation will be dependent upon mutual agreement only.

 

 

 

4. Inspection, Quality & Quantity:

 

 

 

All pictures to be shared with the customer at the time of loading. If the buyer chooses to be present at the time of loading, he must inform at the time of finalisation to make provision for the same. Rawtech Trade shall be deemed to have fulfilled our contract by delivering of material as per pictures or samples provided. Raw tech will be liable to compensate if the material is not as per pictures or samples.We shall be deemed to have fulfilled our contract by delivery of a quantity within 10% plus or minus of the quantity agreed.

 

Revised Proforma will be issued accordingly after the loading. Limited liability: We herewith denying from any financial liabilities causing:

 

  • a) Non execution of shipment or
    • b) Any damage to the machines during process because of any defect/problem/contamination in the material. Buyer is required to check the material the before using it in any further application.

       

       

      5. Delivery, Acceptance & Claims

       

      Buyer fails to accept delivery of Goods; Seller will have the right to store or arrange storage of the Goods at Buyer’s risk and expense. Buyer will promptly pay for the reasonable costs of storage and insurance of the Goods until delivery. Seller will not accept any returns of Goods without Seller’s prior approval. Acceptance of the material and quality should be confirmed within 5 days from date of receipt of the material after the required internal checking and testing, if any. In case of any quality issues, please provide Rawtech Trade a full survey report of the goods along with the picture and samples. If nothing is reported to us within 5 days after receipt of the material, it would be treated as undisputed accepted raw material and no claims will be accepted thereafter.

       

      6. Cancellation

       

      Contracts or orders may not be cancelled except by agreement in writing of both parties and upon the payment to the Seller of such amount as may be necessary to indemnify the Seller against all loss resulting from the said cancellation.The seller is not liable to return the initial deposit payment unless mutually agreed.

      This contract is subject to our general conditions of sales sent separately by post/mail. By accepting this contract, the buyer has explicitly confirms having received and seen the general conditions of sales. These general conditions form an integral part of the agreement. Execution of this contract implies that the buyer renounce in full the application of its own terms and conditions
